FINAL FINDINGS
(New shipper review)
New Shipper Review under Rule 22 of the Anti-dumping
Rules for determination of individual dumping margin on
imports of “Phosphoric Acid-Technical Grade and Food
Grade (including Industrial Grade)” originating in or
exported from China PR by M/s Guangxi Qinzhou Capital
Success Chemical Co. Ltd. (Producer) from China PR –
Termination thereof.
Based on a request by M/s Guangxi Qinzhou Capital Success Chemical Co. Ltd., China PR
(Producer/exporter) under Rule 22 of Customs Tariff (Identification, Assessment and Collection of Anti-
Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 as amended from time to
time, (hereinafter referred to as the AD Rules), the Authority initiated a New shipper review (NSR) vide
notification no. NSR 1/2017 dated 9/2/2017 (Case no. NSR 1/2017) on imports of Phosphoric Acid-Technical
Grade and Food Grade (including Industrial Grade)” originating in or exported from China PR, by
M/s Guangxi Qinzhou Capital Success Chemical Co. Ltd. (Producer).
2. The Authority considered the POI as 1st January, 2016 to 31st December, 2016.
3. M/s Guangxi Qinzhou Capital Success Chemical Co. Ltd. (Producer), M/s Qinzhou Municipality Qinzhou
Port Huapu Food Additives Co., Ltd. (Exporter), and M/s Guangxi Qinzhou Capital Success Phos-Chemical
Co. Ltd. (Exporter) filed responses to the exporters Questionnaire including the Market Economy Treatment
questionnaire.
4. However, M/s Guangxi Qinzhou Capital Success Chemical Co. Ltd. (Producer) through letter dated
10/11/2017 (filed through their legal representive M/s APJ-SLG Law offices) have withdrawn their
application for New shipper review.
5. The Authority in view of the above request hereby decides not to carry out any individual determination
under Rule 22 of AD Rules and terminates the New shipper review initiated vide notification no. 15/5/2016-
DGAD (Case no. NSR 1/2017) dated 9/2/2017.
