Prevention of Money-laundering Third Amendment Rules, 2015

Cell) | In exercise of the powers conferred by sub-section (1) read with clauses (i), (j), (jj), (jjj) and (k) of sub-section (2) of section 73 of the Prevention of Money-laundering Act, 2002 (15 of 2003), the Central Government in consultation with the Reserve Bank of India hereby makes the following rules further to amend the Prevention of Money-laundering (Maintenance of Records) Rules, 2005, namely:- 1. (1) These rules may be called the Prevention of Money-laundering (Maintenance of Records) Third Amendment Rules, 2015. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Prevention of Money-laundering (Maintenance of Records) Rules, 2005, in rule 2, in sub-rule(1), in clause (d) the following explanation shall be inserted, namely :- ‘Explanation.- For the purpose of this clause, a document shall be deemed to an “officially valid document” even if there is a change in the name subsequent to its issuance provided it is supported by a marriage certificate issued by the State Government or Gazette notification, indicating such a change of name.’. 3. In the Prevention of Money-laundering (Maintenance of Records) Rules, 2005, in rule 7,- (a) in sub-rule (3),- (i) after the words “issued by”, the words “the Director in consultation with, its” shall be inserted; (ii) after the words “directed by”, the words “the Director in consultation with,” shall be inserted; (b) in sub-rule (4), after the words “specified by”, the words “the Director in consultation with,” shall be inserted.
