DGAD to review anti-dumping duties on Viscose Staple Fibre
In a latest notification, the Directorate General of Anti-Dumping & Allied Duties (DGAD), has recommended for the imposition of anti-dumping duty on imports of ‘Viscose Staple Fibre excluding Bamboo Fibre’ from the People’s Republic of China and Indonesia. However, the authority intends to review the period of imposition of anti-dumping duty through a sunset review. Following final findings published by the Authority vide Notification No.14/6/2009-DGAD dated May 17, 2010, a definitive anti-dumping duty, on said items, was imposed by the Central Government vide Notification No 76/2010 dated July 26, 2010. However, a petition has been filed by the Association of Man-Made Fibre Industry of India, on behalf of the domestic industry for the product under consideration. In the petition, the Association has asked for the extension of period, modification and enhancement of existing anti-dumping duties on imports of said items from the said-countries. The petition has also claimed that there is no difference between the items exported by the said countries and same items being produced by the Indian industry. Both the products have comparable characteristics in physical and chemical characteristics, manufacturing process and technology, pricing, distribution and marketing and tariff classification, claimed the petition. Through the initiation of the sunset review, the authority intends to review the need for continued imposition of the duties in force in respect of the subject goods from the subject countries and will also examine whether the expiry o such duty is likely to lead to continuation of recurrence of dumping and injury to the domestic industry. In this regard, the authority also seeks submissions from the exporters of said items belonging to the subject countries within 40 days period from the date of publication of this notification, i.e, July 22, 2015. And, in case, the submissions are not reached by the expected time, the authority notified that it would record its findings on the basis of the facts available with it and make such recommendations to the Central Government. Viscose Staple Fibre was the first man-made fibre, and unlike other man-made fibres, is not a synthetic fibre, which is made through wet spinning technology and is a regenerated cellulose fibre made from wood pulp.
