JT. DGFT MUMBAI TRADE NOTICE

To
All concerned.

Amendment of IEC

Attention of the Trade is invited towards following provisions relating to Modification of IEC under paragraph 2.14 (b) of the Handbook of Procedures, effective from 1.4.2015:

“An application for modification may be made for change in details like name, address, constitution, ownership in Proprietorship firms, change in the nature of the firm e.g. from proprietorship to partnership etc. Change in constitution however, does not include change in Directors of Public Limited Company.”

2. In the Handbook of Procedures notified made effective from 5.12.2017, the above provisions under paragraph 2.14 (b) relating to modification of IEC now reads as under:

“An application for modification may be made for change in details like name, address, constitution, ownership in Proprietorship firms, change in the nature of the firm e.g. from proprietorship to partnership etc.”

3. As can be seen from above, with effect from 5.12.2017, the change in Directors of the Public Limited Company has to be considered as change in constitution of Public Limited Company and therefore necessary modifications must be made in the IEC of the Company.

4. All Stake Holders are hereby requested to take cognizance of above amendment in the Handbook of Procedures effective from 5.12.2017 relating to modification of IEC consequent to change in Directors of Public Limited Company and make necessary modifications in IEC within 30 days from the date of issue of this trade notice.

5. This may please be given wide publicity amongst all members of the Trade.
