Provisions of specified sections of Article I, II, III, V and VI of the schedule appended

Whereas, an inter-governmental agreement between the BRICS countries relating to establishment of the New Development Bank (hereinafter referred to as the Bank) was signed at Fortaleza on 15th July, 2014;

And whereas, the said inter-governmental agreement was ratified by the Government of India on 25th March, 2015;

And whereas, Article 28, 29, 30, 31, 32, 33, 34, 35 and Article 36 of Chapter VI of the Annex to the said inter-governmental agreement provide for privileges and immunities of the Bank, its representatives and officials;

And whereas, the Central Government considers it expedient to extend the necessary privileges and immunities provided under the United Nations (Privileges and Immunities) Act, 1947 (46 of 1947) to the Bank, its represetatives and officials;

Now, therefore, in exercise of the powers conferred by section 3 of the United Nations (Privileges and Immunities) Act, 1947 (46 of 1947), the Central Government hereby declares that the provisions of section 1 of Article I, sections 2, 3, 4, 5, 6 and section 7 of Article II, section 9 of Article III, clauses (a), (b), (c), (d) and (e) of section 18 and section 20 of Article V and clauses (a), (b), (c), (e) and (f) of section 22 and section 23 of Article VI of the Schedule to the said Act shall apply, mutatis mutandis, to the New Development Bank, its representatives and officials.
