
Regarding Security Council Resolution 827 - 1993

Whereas, the Security Council at its 317th Meeting adopted resolution 827 (1993) [appended to this Order as Annexure I], under Chapter VII of the Charter of the United Nations which established an International Tribunal for the sole purpose of prosecuting persons responsible for serious violations of international humanitarian law committed in the territory of the former state of Yugoslavia;
And whereas, the same resolution also decided that all states shall cooperate fully with the International Tribunal and its organs in accordance with the resolution 827(1993) and the Statute of the International Tribunal [appended to this Order as Annexure II],;- and that consequently all States shall take measures necessary under their domestic law to implement the provisions of the present resolution and the Statute, including the obligation of States to comply with requests for assistance or orders issued by a Trial Chamber under Article 29 of the Statute;
And whereas, the Trial Chamber I of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law in the Territory of the former state of Yugoslavia since 1991 (The Tribunal) passed an ex parte order dated the 5th October, 2016 and sent to all United Nations member states, indicting Petar Jojic, Jovo Ostojic and Vjerica Radeta for contempt of the Tribunal and interfering with witnesses;
And whereas, the Trial Chamber I of the International Tribunal passed an ex parte order dated the 5th October, 2016 and sent to all authorities, officers and all agents of United Nations member states, to act promptly with all due diligence to secure the arrest, detention, and transfer to the Tribunal of the aforesaid three persons namely Peter Jojic, Jovo Ostojic and Vjerica Radeta;
Now, therefore, in exercise of the powers conferred by section 2 of the United Nations (Security Council) Act, 1947 (43 of 1947) and complying with the Security Council Resolution 827 (1993), the Central Government hereby makes the following order that the law enforcement agencies of India shall;
(i) act promptly to secure the arrest, detention of the following persons and transfer to the Registrar, International Criminal Tribunal for the former Yugoslavia (ICTY), International Court of Justice, Peace Palace, Carnegieplein 2, 2517 KJ The Hague, The Netherlands.
