Specified provisions of United Nations (Privileges and Immunities) Act, 1947

Whereas the Government of India has entered into a Memorandum of Agreement represented through Secretary, Department of Agriculture, Cooperation and Farmers Welfare with International Rice Research Institute (IRRI), Philippines represented by the Director General for establishment of the International Rice Research Institute, South Asia Regional Centre (ISARC) at campus of National Seed Research and Training Centre, Varanasi, Uttar Pradesh on 2nd August, 2017.

And whereas, the said agreement has been ratified by the Government of India on 12th July, 2017;

And whereas, the Government of India recognises IRRI as an international organization to accord privileges and immunities to it and its all offices and activities in India including ISARC;

And whereas, Section 1 of Article I; and Sections 2, 3, 4, 5 and 7 (subject to restrictions of Sections 6 and 8, of Article II of Schedule to the Act), Section 18 and Section 19 of Article V of the United Nations (Privileges and Immunities) Act, 1947 (46 of 1947) provide for privileges and immunities;

And whereas, the Central Government considers it expedient to extend the necessary privileges and immunities, provided in the United Nations (Privileges and Immunities) Act, 1947 to IRRI and all its offices and activities in India including ISARC;

Now, therefore, in exercise of the powers conferred by section 3 of the United Nations (Privileges and Immunities) Act, 1947 (46 of 1947), the Central Government hereby declares that the provisions of Section 1 of Article I; and Sections 2, 3, 4, 5, 7 (subject to restrictions of Sections 6 and 8, of Article II of Schedule to the Act), Section 18 and clause (b) of Section 18 and Section 19 of Article V of the United Nations (Privileges and Immunities) Act, 1947 shall apply, mutatis mutandis, to IRRI and all its offices and activities in India including ISARC, to the extent as specified hereunder, namely:-

(i) Section 1 of Article I; and Sections 2, 3, 4, 5, and 7 subject to restrictions of Sections 6 and 8 of Article II of the Schedule to the Act;

(ii) Section 18 of Article V of the Schedule to the Act in respect of non-Indian scientists and officials;

(iii) Clause (b) of Section 18 of Article V of the Schedule to the Act in respect of the Indian scientists and officials who are recruited through open global competition, to work for IRRI;

(iv) Section 19 of Article V of the Schedule to the Act in respect of non-Indian Directors General of IRRI and Director of ISARC in India.
